Ombudsman for Small and Medium-Sized Enterprises in Mediation Proceedings
Abstract
This article considers the role of the Ombudsman for Small and Medium-Sized Enterprises in mediation proceedings and discusses the legal basis for the SME Ombudsman’s operations and his tasks in the context of disputes between entrepreneurs and public administration bodies, while also highlighting the specific nature of administrative mediation and its significance for the SME sector. The author focuses on an analysis of current legal regulations, while also taking into account the proposed amendments to the Act of March 6, 2018, on the Ombudsman for Small and Medium Sized Enterprises, which establishes new conditions for mediation between businesses and public authorities, while strengthening the role of the SME Ombudsman. The conclusions indicate that the Ombudsman’s role may raise legitimate doubts of a theoretical and practical nature, bringing the Ombudsman closer to the role of a quasi-representative of the entrepreneur rather than an objective and neutral mediator.
