The principle of the specificity of legal provisions in the law-making process

Abstract


The paper brings up the theme of interpretation of the principle of the specificity of legal provisions in the law-making process in Poland. The study is focused mainly on the comments on this question made by academics and also by the Polish Constitutional Tribunal. The analysis firstly concerns Article 2 of the Polish Constitution, which provides the principle of the democratic and ruled by law state. On the basis of the general analysis of this article the author next shows the specific rules which are adquate for the analyzed problem, mainly in the context of individual rights guarantees.
