„ABOLITION OF THE PARASITE STATE”. HISTORICAL AND LEGAL ANALYSIS OF REGIME OF THE PARIS COMMUNE OF 1871

Abstract


This article contains the analysis of the regime of The Paris Commune of 1871 that is divided in two parts. The first part deals with the regime of the Commune in stricte legal way. The second one is about the influence of the Commune in creating the concept of dictatorship of the proletariat. Regime of The Paris Commune was a very interesting example of rupture with the separation of powers. The main thesis of the paper is that the Marxists used only selected elements of the legacy of the Commune to justify their idea of totalitarian state known as a dictatorship of the proletariat. The Paris Commune was the fourth big French revolution (the last one of the 19th century) and had a positive impact on the later forms of the French state.
