Zalety i wady Afrykańskiej Karty Praw i Dobrobytu Dziecka
Streszczenie w języku polskim
Afryka jest jedynym regionem, w którym stworzona została wielostronna umowa międzynarodowa mająca chronić prawa dziecka – Afrykańska Karta Praw i Dobrobytu Dziecka (AKPD). Celem jej twórców było zapewnienie afrykańskich ram dla ochrony i promocji praw dzieci w Afryce. Traktat ten nie powstał w próżni prawnej, poprzedzony został bowiem licznymi dokumentami międzynarodowymi o charakterze uniwersalnym i regionalnym w postaci deklaracji i konwencji, których przedmiotem są prawa dzieci. Interpretując kolejne postanowienia AKPD w postaci katalogu praw dziecka ściśle powiązanego z kulturą regionu, można wskazać jej mocne i słabe strony. Do zalet AKPD z pewnością można zaliczyć m.in. dostosowanie traktatu do realiów kontynentu afrykańskiego i kompleksowe podejście do ochrony praw dzieci, obejmujące wszystkie kategorie praw. Jedną z wad tego aktu jest zaś m.in. brak wskazania definicji pojęć wyartykułowanych w poszczególnych przepisach.
